HANDBOOK CONTENT (May 15, 2026):

EMPLOYMENT BASICS
- At-will employment: either party can end employment anytime, with or without cause. No oral statement changes the handbook; only written management approval can create an exception.
- Introductory period: first 90 days for all new hires (mechanics have a detailed 90-day evaluation on diagnostics, tool use, safety/OSHA compliance, repair quality, productivity, teamwork, attendance). Company may extend it. Completing it does NOT change at-will status or guarantee benefits eligibility timing beyond what's stated (full-time employees become benefits-eligible the 1st of the month following end of probation).
- Employment categories: Active Full-Time (regular full-time schedule, eligible for benefits), Part-Time (regularly under 30 hrs/week, only legally mandated benefits like Social Security/workers' comp), Introductory, Temporary (no company benefit programs beyond legally mandated ones).
- Exempt vs Non-Exempt: classification can only be changed by written notice from management. Non-exempt = overtime eligible.
- Job abandonment: no-call/no-show (failing to personally call in) for 2 consecutive days = considered voluntary resignation.

SCHEDULE, PAY & TIME
- Normal schedule: 6 days/week, 8:00am-5:00pm Mon-Fri, 8:00am-1:00pm Saturday. Seasonal (Apr-Jun) hours may run later. Saturdays required due to retail nature of business.
- Clock in/out: no more than 15 min early or late without supervisor consent. Must clock in/out at electronic time clock, including for meals.
- Meal periods (NY law): 30-min unpaid meal between 11am-2pm for shifts >6 hrs spanning that window; 45-min unpaid meal midway through shifts starting 1pm-6am and lasting >6 hrs; additional 20-min unpaid meal 5-7pm for shifts spanning before 11am to after 7pm.
- One paid 10-minute break per 4 hours worked.
- Pay period: weekly, Monday-Saturday. Paychecks distributed Friday.
- Overtime: paid to non-exempt employees per federal/state law, based on actual hours worked (PTO/leave doesn't count toward OT calc).
- No pay advances or loans from the company.
- Direct deposit available — see Office Manager.
- Don't discuss pay with co-workers (company policy).

VACATION & HOLIDAYS
- Paid holidays (full-time only; part-time not eligible): New Year's Day, Memorial Day, July 4th, Labor Day, Thanksgiving, Christmas Day. Must work full scheduled day before AND after the holiday to be eligible unless pre-approved off. Holiday pay doesn't count as hours worked for OT.
- Vacation PTO (full-time, 1+ year of service only; part-time NOT eligible): 10 days/80 hrs after 12 months; 15 days/120 hrs after 5 years (60 months); 20 days/160 hrs after 15 years. Does NOT carry over year to year. Must request 3 weeks in advance on Request for Time-Off form, manager-approved, first-come-first-served based on staffing needs. Vacation pay = current pay rate, no bonuses/special comp included.

NEW YORK SICK LEAVE & OTHER NY LEAVE
- NY Paid Sick Leave: ALL employees eligible. 40 hours provided at start of each leave year (leave year = anniversary of hire date). Minimum use increment = 4 hours. Unused hours carry over but usage capped at 40 hrs/year. Paid at regular rate or minimum wage, whichever greater. Can be used for own/family illness, diagnosis/care/treatment, or domestic violence/family offense/stalking/trafficking related needs. 3+ consecutive days of use may require documentation (medical note or self-attestation — no details of illness required). No payout of unused sick leave at termination.
- NY Paid Family Leave (PFL): up to 12 weeks at 67% of weekly pay (capped at 67% of statewide average) for bonding with new child, caring for family member with serious health condition, or military deployment of family member. Full-time eligible after 26 consecutive weeks; part-time after 175 days worked. Employee-funded via payroll contribution. 30 days advance notice if foreseeable. Runs concurrently with FMLA where applicable. Can't combine with short-term disability beyond 26 combined weeks/52-week period.
- NY Paid Prenatal Personal Leave: 20 hours/52-week period, hourly increments, for pregnancy-related healthcare appointments/procedures. Paid at regular rate or minimum wage. In addition to NY Sick Leave. No documentation required.
- NY Disability Benefits (DBL): short-term wage replacement for non-work illness/injury/pregnancy disability lasting 7+ days. Full-time eligible after 4 consecutive weeks of covered employment; part-time after 25 days in 52 weeks. Up to 26 weeks of partial wage replacement per 52-week period, starting on day 8 of disability. Payroll-deducted contribution.
- Unpaid Leave of Absence: discretionary (except where law requires), for medical/family/pregnancy/education, etc. Medical certification required for medical/pregnancy leave. No benefit accrual during unpaid leave; after 30 days employee pays own insurance premiums. Medical leave capped at 4 months. Failure to return as scheduled may = termination.
- Bereavement leave: for immediate family (spouse, parent, child, sibling, spouse's parent/child/sibling) — notify supervisor, may use available PTO.
- Jury Leave: unpaid, can use vacation PTO if desired; show summons to supervisor ASAP; health insurance continues, vacation/holiday accrual continues.
- Voting Leave: up to 2 hours paid if insufficient time outside work hours (need 4 consecutive hours before/after shift with polls open to NOT qualify); request from manager at least 2 working days ahead.
- Military Leave (USERRA): unpaid, job-protected reinstatement; benefit accrual suspended during leave, resumes on return; return within 30 days after training or 90 days after discharge.
- Military Spouse Leave: up to 10 unpaid days for spouse of deployed service member (combat zone), if averaging 20+ hrs/week.
- Blood/Bone Marrow Donation Leave: up to 3 hrs unpaid/year for blood donation (3 working days notice required); unpaid time per physician for bone marrow donation (up to 24 hrs without company approval), for employees averaging 20+ hrs/week.
- Crime Victim/Witness Leave: unpaid time for subpoenaed testimony, victim impact statements, sentencing/parole hearings, for victims, next of kin, Good Samaritans, etc.
- Domestic Violence Victim Accommodations: reasonable time off for medical care, shelter/counseling services, safety planning, legal proceedings. Documentation required for unscheduled absences (police report, court order, or provider documentation). Confidential.
- Nursing mothers: 30 min PAID lactation breaks whenever reasonably needed, for up to 3 years after birth; additional time can come from existing paid breaks/meal time. Private room (not a restroom) provided, with chair, surface, water access, outlet. Give advance written notice preferably before returning from leave; company responds within 5 business days.
- Pregnancy/childbirth accommodations (PWFA): additional breaks, seating, schedule changes, part-time, telework, closer parking, light duty, job restructuring, equipment/uniform changes, etc. Notify manager; medical documentation often NOT required (obvious cases, presumptively reasonable requests like extra breaks, or lactation).

BENEFITS
- Health/life/LTD insurance: full-time employees only, benefits-eligible 1st of month following end of probation.
- COBRA available on qualifying events (termination, reduced hours, divorce, etc.) — contact HR.
- Workers' Comp: covers work-related injury/illness, no cost to employee. Report injuries to supervisor IMMEDIATELY regardless of severity.
- Unemployment insurance available if job loss unrelated to misconduct/policy violation.
- Employee discount: full-time employees with 6+ months service. Personal use only (not for friends/family/resale). Parts discount: cost, capped at $1,000, then list-less-10%. Equipment discount set at time of purchase. Must pay cash/check at purchase unless prearranged; in-house account 30+ days past due = $25/week payroll deduction. Used equipment must be in inventory 90+ days minimum. Discount purchases must happen during break time.

CONDUCT, DISCIPLINE & WORKPLACE RULES
- Progressive discipline: verbal warning → written warning → suspension → termination, depending on severity; steps can be skipped for serious issues. Company may drug test at any time.
- Personal appearance: LOGO uniform shirts required for Parts/Service during business hours; clean/neat/tasteful appearance; clothing must cover torso/midriff/mid-thigh/cleavage/buttocks, no sagging; trimmed facial hair; no offensive body odor; moderate/no strong fragrance; no facial jewelry (eyebrow/nose/lip rings, tongue studs) during business hours.
- Drug & alcohol: prohibited on premises/at work; reasonable-suspicion testing allowed (physical evidence, accident, performance drop); refusal to test = disciplinary action up to termination; mandatory drug test after any police-reported vehicle accident.
- Smoke-free workplace: prohibited throughout including company vehicles.
- Phone/cell phone: personal calls limited to two 5-minute calls/day (counts as break time); business use only otherwise.
- Email/internet/voicemail: company property, business use only, subject to monitoring.
- Mobile device while driving: no handheld calls/texting/internet while vehicle in motion (hands-free Bluetooth only); violations can lead to warnings up to termination.
- Company vehicles: drive safely/courteously, report damage/accidents, employee responsible for own traffic fines; MVR checked (annually under 25, every 3 years otherwise, or after driving review); disqualifying violations include DUI, reckless driving causing injury, license suspension, 3+ violations/accidents in 3 yrs (2 for ages 18-24, 1 for 17 and under); no personal passengers other than company employees; seatbelts required; cargo secured.
- Workplace violence: zero tolerance for threats/intimidation/weapons on premises; report to supervisor/management immediately.
- Non-compete/confidentiality: employees prohibited from competing side work (e.g., repairing equipment off-hours that competes with the business); confidentiality/non-solicitation/limited non-compete agreement required as condition of employment.
- Outside employment: allowed unless it interferes with job performance; may be asked to end it if it does.
- Employee arrest/conviction: may lead to discipline including termination depending on job-relatedness and impact on attendance/performance, regardless of court outcome.
- Security: lock up desks/valuables when leaving; report lost keys/passes immediately; internal theft = termination + possible prosecution.
- No expectation of privacy in company property (desks, lockers, phones, computers, vehicles) — subject to inspection anytime without notice.

HIRING, HARASSMENT & DISCRIMINATION
- EEO/anti-discrimination: protected classes include race, color, religion, age, sex, sexual orientation, gender identity, national origin, disability, pregnancy/reproductive health decisions, marital/familial status, domestic violence victim status, military status, immigration status, genetic info, etc.
- Reporting harassment/discrimination: tell your immediate supervisor first. If uncomfortable, or supervisor is the source/ignores it, go to Laura Bentley or Human Resources/management directly. Complaint form available (attached to handbook) but not required — verbal or written (email) complaints treated equally.
- Sexual harassment doesn't need to be "severe or pervasive" to violate policy in NY — just above petty/trivial. Both hostile-environment and quid pro quo harassment covered. Intent doesn't matter, impact does.
- Retaliation for reporting is prohibited and is itself a violation.
- External options: NYS Division of Human Rights (718-741-8400, dhr.ny.gov, complaint within 3 years) or EEOC (800-669-4000, eeoc.gov, complaint within 300 days). NYC employees also can use NYC Commission on Human Rights. Criminal conduct → contact local police.
- Reproductive Health Rights: company won't access info on your/your dependents' reproductive health decisions without written consent, and won't discriminate/retaliate based on it.
- Immigration: I-9 required for all new hires (and rehires without a valid I-9 in the past 3 years); no discrimination based on citizenship/national origin; contact Office Manager with questions.

TERMINATION & RECORDS
- Termination types: resignation, discharge, retirement.
- Exit interview covers benefits/COBRA, return of company property, outstanding debts, final pay per state law.
- Access to personnel file: contact Office Manager, review in office with a company-appointed person present, reasonable notice required.
- Personnel data changes (address, phone, marital status, dependents, emergency contacts): must be reported promptly to Office Manager. False info = grounds for discipline up to termination.
- Credit/employment verification requests: Office Manager responds in writing only to written requests, confirms only dates/wages/positions, requires signed release from the employee.

MISC
- Company reserves right to amend the handbook; employees notified of changes. Handbook is not a contract.
- Signed Employee Acknowledgement Form required within 1 week of hire.
- New Employee Checklist covers I-9, W-4, harassment policy, safety training, facility tour, time clock procedures, etc. on day one.
